Terms of Use

These Terms of Use (“Terms”) govern your use of the Bunting mobile applications for iOS and Android (the “Service”), operated by Rivolu LLC (“we”, “us”). By using the Service you agree to them. If you do not agree, do not use the Service.

1. Your licence to use the app

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use Bunting on devices you own or control, for your own non-commercial use, subject to these Terms and to the terms of the store you installed it from.

If you installed from the App Store

Your licence is granted under Apple’s standard Licensed Application End User Licence Agreement (the “Apple EULA”), which is an agreement between you and Rivolu LLC rather than with Apple. Where the Apple EULA conflicts with these Terms in respect of that licence, the Apple EULA prevails for the licence; these Terms govern everything else. You also agree that:

2. Who can use it

You must be at least 13 years old and able to enter into these Terms. You are responsible for your account credentials and for what happens under your account.

3. What it costs

Bunting is free to use today, and whatever happens to pricing, everything you have logged stays yours.

We may introduce charges for parts of the Service in future — including features that are free now — and we may limit or meter a feature that is currently unrestricted. If that happens you will be told first, and nothing is charged unless you choose to pay. Declining means losing access to that part; your journal, your records and your photographs remain yours, and you can export them at any time.

Any purchase made through the App Store or Google Play is processed by Apple or Google under their terms, and is subject to their refund policies rather than ours.

4. Your eBird API key

Bunting can show recent eBird checklists on the map and in your feed. This works only if you supply your own eBird API key, which you obtain directly from eBird.

5. Third-party data and integrations

Parts of the Service display data published by others: occurrence records from GBIF, acoustic detections from BirdWeather identified by BirdNET, and eBird checklists retrieved with your own key. Each is credited in the app.

Bunting is independent. It is not affiliated with, endorsed by, sponsored by, or otherwise associated with GBIF, BirdWeather, BirdNET, eBird, or the Cornell Lab of Ornithology. Their names and marks belong to them.

Any integration may be removed at any time, with or without notice. These services are outside our control. They may change their terms, their pricing, their data, or their availability; they may block us; they may cease to exist. We may also choose to remove an integration for our own reasons. When that happens the corresponding feature will stop working, and we accept no liability to you for its loss. No integration is a promised or permanent part of the Service, and nothing you have paid for — now or in future — will be taken to include a guarantee that a particular third-party feature continues.

Data from these sources is provided to you as it reaches us. We do not verify it, and we make no warranty as to its accuracy, completeness, or currency.

6. How you may use the data

Bunting shows you other people’s observations — theirs, and other birders’ sightings shared through the app. You agree to treat them accordingly, and specifically not to:

Where a third party’s own licence applies to their data — GBIF’s dataset licences, eBird’s terms — those terms bind you in addition to these, and in the event of a conflict the stricter applies.

7. Your records

Your sightings, outings, photographs and notes remain yours. By sharing an outing publicly you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce and display it within the Service so that other birders can see it, and to use aggregated or de-identified information derived from it to operate and improve the Service. You confirm you have the right to share whatever you upload.

You can export everything you have logged at any time, and delete your account — which removes your records from our systems. See the Privacy Policy for what is kept and for how long.

We may remove shared content that breaks these Terms or that we consider harmful, and may suspend or close an account that does so repeatedly. We do not pre-screen what birders share.

8. What Bunting is not

Bunting is for recording and enjoying birding. Identifications, including those made by voice recognition or by any model, are suggestions and are frequently wrong. Maps, trails and distances are approximate.

Do not rely on the Service for navigation, for safety, or for any decision where being wrong could cause injury or damage. Follow local access rules and wildlife law, and use your own judgement in the field.

9. Availability

The Service is provided “as is” and “as available”. We do not guarantee it will be uninterrupted, timely, secure or error-free, and we may modify, suspend or discontinue any part of it — including any feature, data source or integration — at any time, with or without notice.

10. Liability

To the maximum extent permitted by law, Rivolu LLC is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or opportunity, arising from your use of the Service. Where liability cannot be excluded, it is limited to the greater of the amount you have paid us for the Service in the twelve months before the claim, or twenty-five US dollars.

You agree to indemnify and hold harmless Rivolu LLC and its officers, employees and contractors against claims, damages and costs (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, your use of your own eBird key, your misuse of data obtained through the Service, or your infringement of anyone’s rights.

11. Changes to these Terms

We may revise these Terms. If a change is material we will make reasonable efforts to give notice before it takes effect, in the app or by email. Continuing to use the Service after that means accepting the revised Terms.

12. Privacy

Your use of the Service is also governed by our Privacy Policy.

13. General

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. If any provision is held unenforceable, the rest remains in force. Our not enforcing a provision is not a waiver of it. You may not assign these Terms; we may, including to a successor or acquirer. You consent to receive notices from us electronically.
